Terms and Conditions of Use

The Material Handling Industry, its Division (Material Handling Industry of America, “MHIA”), College-Industry Council on Material Handling Education (“CICMHE”), (collectively “Sponsors”) provide all information on the Site exclusively under the following Terms and Conditions of Use:

1.  Purpose

The Site contains a collection of photos and videos showing various types of material handling equipment, systems and interfaces.  The Site is intended for educational use by students and tutors in material handling.  Information on the Site also may be used by instructors in the classroom environment or by the industry for general education and training.

2.  License and Restrictions on Usage

You are granted a nonexclusive, nontransferable, limited license to view, download, reproduce, print and distribute information from the Site provided:

(a) the Site and its information are used only for personal, informational and/or non-commercial purposes;

(b) you do not modify any of the information; and

(c) you do not remove or obscure any copyright or other notice.

Except as provided above, no part of the Site may be reproduced, republished, copied, transmitted, distributed or stored in any form or by any means.  You agree to indemnify, defend and hold Sponsors and their affiliates harmless against any claims (including attorneys’ fees) arising out of or in any way related to your use of the Site under this limited license.

3.  Submitter’s Grant of License

By submitting information to the Site, you (1) grant Sponsors and their affiliates the right to use, reproduce, download, print, display, adapt, modify and distribute the information on the Site; (2) grant users of the Site a nonexclusive, nontransferable, limited license in accordance with Paragraph 2 above; and (3) represent that you own or otherwise control all rights in and to the information and that use of the information as provided herein will not infringe or violate the rights of any third party.  You agree to indemnify, defend and hold Sponsors and their affiliates harmless against any claims (including attorneys’ fees) arising out of or in any way related to your submission of information, representations herein or grant of license.

4.  Limitation of Liability

Under no circumstances shall Sponsors or their affiliates be liable for any direct, indirect, punitive, incidental, special or consequential damages of any kind whatsoever (including attorneys’ fees and lost profits) in any way due to, resulting from or arising in connection with, the Site, including its content, regardless of whether such alleged liability is based on contract, tort, negligence, strict liability or any other theory.

5.  Disclaimer

The Site is provided on an “as is,” “as available” basis and Sponsors disclaim all warranties, including the implied warranties of merchantability, fitness for a particular purpose and noninfringement.  The information contained on the Site is submitted by various providers and vendors.  Sponsors do not endorse, approve or certify such information, nor do they guarantee the accuracy, completeness or efficacy of such information.  Use of such information is voluntary, and reliance on it should be undertaken only after an independent review of its accuracy, completeness and efficacy.

6.  Acceptance of Terms and Conditions of Use

By using the Site, you signify your agreement to these Terms and Conditions of Use.  If these Terms and Conditions of Use are not acceptable in full and if you do not otherwise agree to them in their entirety, you must immediately terminate your use of the Site.
